Terms of Service

Effective Date: July 2026

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and CUSTOMOTO COMPUTER PROGRAMMING SERVICES, a sole proprietorship registered with the Department of Trade and Industry of the Philippines (DTI Business Name No. 8091235), Region IV-A (CALABARZON), Philippines ("CustoMoto!", "we", "our", or "us"), governing your use of the CustoMoto! mobile application ("App").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

CustoMoto! is a motorcycle customization application currently available for Android devices via Google Play. The App provides:

A visual customizer for previewing motorcycle color schemes and scenic backgrounds
MotoBot, an AI-powered assistant for motorcycle advice and information
A parts advisory catalog and a community parts-submission program (Parts Bounty)
A nearby motorcycle stores finder (subscription feature)
Clan community features, including clan creation, membership, and chat
Moto Coins, a virtual in-app currency, and related reward features (daily rewards, login streaks, and quests)
Free and paid subscription tiers with different feature levels

We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice.

3. Eligibility and Account Registration

You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian.
You must provide accurate and complete information when creating your account and keep it up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You may not create an account using another person's identity, share your account, or maintain multiple accounts for the purpose of abusing rewards or promotions.
Notify us immediately at wrathfulrealm@gmail.com if you suspect unauthorized use of your account.

4. User Conduct

You agree NOT to:

Use the App for any unlawful purpose or in violation of Philippine law
Post or transmit content that is abusive, harassing, defamatory, obscene, or otherwise objectionable, including in clan chats, usernames, and build names
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Attempt to gain unauthorized access to the App, other user accounts, or our systems
Use bots, scripts, exploits, or automation to interact with the App, farm rewards, or manipulate any in-app system
Reverse engineer, decompile, or attempt to extract the source code of the App
Interfere with or disrupt the operation of the App or its servers
Submit false, duplicate, or junk content to community programs such as Parts Bounty

We use automated filters (including Filipino/Tagalog profanity checks) on user-entered names and community content. We may remove content, restrict features, or suspend accounts that violate this section.

5. Purchases, Subscriptions and Payments

5.1 Moto Coins and In-App Purchases

The App offers Moto Coins, a virtual currency that can be purchased with real money or earned through in-app activity (such as daily rewards, streaks, quests, and approved community contributions). Moto Coins can be spent within the App on virtual items such as color unlocks, scenic backgrounds, rename vouchers, and streak shields. The App also offers certain one-time real-money purchases (such as streak recovery).

5.2 Payment Processing

All in-app purchases and subscriptions are processed exclusively through Google Play Billing (Google LLC). Your payment method (such as your card or e-wallet) is handled by Google under Google's own terms and privacy policy; we do not receive or store your full payment details. Prices are shown in Philippine Pesos (₱) at the point of purchase and may change; any change will apply only to future purchases or renewal periods.

5.3 Subscriptions and Auto-Renewal

The App offers paid subscription tiers (currently Rider Pro and Captain) on monthly and yearly plans.
Subscriptions are auto-renewing. Your Google Play account will be charged the displayed price at the start of each billing period, and the subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
You can manage or cancel your subscription at any time in the Google Play Store → Payments & subscriptions → Subscriptions. Deleting the App does not cancel a subscription.
If you cancel, you keep your subscription benefits until the end of the period you have already paid for; no partial-period refunds are provided except as described in Section 5.5 or required by law.
If a renewal payment fails, Google may retry it during a grace period; if payment is not completed, your account reverts to the Free Rider tier.

5.4 Virtual Items and Earned Currency

Moto Coins and all virtual items (including colors, backgrounds, vouchers, shields, and cosmetic content) are licensed to you for use within the App only. They are not your property, have no real-world monetary value, and cannot be exchanged for cash, transferred, or sold.
We may modify, rebalance, or discontinue virtual currency and items as part of operating the App. Where we discontinue a purchased item, we will make reasonable efforts to provide a comparable replacement or equivalent in-app value.
All virtual currency and items are forfeited when your account is deleted or permanently terminated for violation of these Terms.

5.5 Refunds

Purchases made through Google Play are subject to Google Play's refund policies. Refund requests for Google Play purchases should be directed to Google Play first. Except where required by the Philippine Consumer Act or other applicable law, all purchases of virtual currency, virtual items, and subscription periods already delivered are final and non-refundable. Nothing in these Terms limits any right you have under mandatory Philippine consumer-protection law.

5.6 Rewards, Streaks and the Referral Program

The App includes promotional reward features such as daily rewards, login streaks, quests, and an Invite a Friend referral program that can grant Moto Coins or free subscription time.
Reward features are promotional benefits, not purchased goods. We may modify reward amounts, rules, eligibility, or availability at any time.
Streak protection limits: a Streak Shield protects one streak break of up to 3 missed days and is limited to 1 owned at a time and 1 purchase per calendar month. Paid Streak Recovery applies only to a streak that missed exactly 1 day, must be purchased within 1 day of returning, and is limited to 3 recoveries per calendar month, with the price increasing for each recovery in that month. A streak that missed 2 or more days in a row cannot be recovered by any means.
Referral rewards are subject to anti-fraud verification. We may withhold, revoke, or reverse rewards obtained through fraud or abuse, including self-referral, fake or duplicate accounts, automation, or other manipulation, and we may suspend accounts involved in such activity.

6. Clans and Community Features

Clan creation is available to Captain-tier subscribers; clan membership rules vary by subscription tier.
Clan leaders are responsible for managing their clans in accordance with these Terms and may remove members from their clans.
Clan names, descriptions, and chat messages must comply with Section 4 (User Conduct).
We may rename, suspend, or remove any clan that violates these Terms.

7. User Content

You retain ownership of content you create or submit through the App (such as build designs, shared images, part submissions, and chat messages) ("User Content").
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content as needed to operate, promote, and improve the App. For community part submissions, this includes incorporating the submitted information into the App's parts catalog for all users.
You represent that you have the rights to any content you submit and that it does not infringe the rights of any third party.
We may remove any User Content that violates these Terms or applicable law.

8. MotoBot AI Assistant

MotoBot is an AI-powered assistant that provides general motorcycle information and suggestions. MotoBot's responses are generated by artificial intelligence and may be inaccurate, incomplete, or unsuitable for your specific situation. MotoBot's output is provided for informational purposes only and is not professional mechanical, safety, or legal advice. Always consult a qualified mechanic and follow your motorcycle manufacturer's guidance before performing modifications or repairs. You use MotoBot's suggestions at your own risk.

9. Intellectual Property

The App, including its name, logo, design, illustrations, software, and all content other than User Content, is owned by CUSTOMOTO COMPUTER PROGRAMMING SERVICES and protected by Philippine intellectual property laws and international treaties. The CustoMoto! name and logo, and the tagline "The vehicle customization app for builders who take their craft seriously," are proprietary to us. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent. Motorcycle makes and models referenced in the App are the trademarks of their respective manufacturers; CustoMoto! is not affiliated with or endorsed by any motorcycle manufacturer.

10. Third-Party Services

The App relies on third-party services, each governed by its own terms and privacy policy:

Google Firebase (authentication, database, storage, cloud functions)
Google Play Billing (in-app purchases and subscriptions)
Google Maps (nearby stores feature)
Anthropic Claude API (MotoBot AI responses)
Expo (push notification delivery)
Cloudinary (image hosting and processing)

We are not responsible for the availability, accuracy, or practices of third-party services.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION PROVIDED THROUGH THE APP (INCLUDING MOTOBOT RESPONSES AND PARTS INFORMATION) IS ACCURATE OR RELIABLE. COLOR PREVIEWS IN THE VISUAL CUSTOMIZER ARE ILLUSTRATIVE AND MAY DIFFER FROM REAL-WORLD RESULTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY PHILIPPINE LAW, CUSTOMOTO COMPUTER PROGRAMMING SERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US THROUGH THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER PHILIPPINE LAW.

13. Termination

You may stop using the App and delete your account at any time via the in-app Settings or by contacting us at wrathfulrealm@gmail.com.
We may suspend or terminate your account, with or without notice, if you violate these Terms, abuse reward systems, engage in fraud, or use the App in a way that harms other users or the service.
Upon termination, your license to use the App ends and your virtual currency and items are forfeited as described in Section 5.4. Provisions that by their nature should survive termination (including Sections 7, 9, 11, 12, and 14) will survive.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the proper courts of the Philippines. Before filing any formal action, you agree to first contact us at wrathfulrealm@gmail.com to attempt a good-faith resolution.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on this page and updating the effective date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

July 2026 update: Corrected platform availability (Android via Google Play), consolidated in-app payment processing to Google Play Billing (removed references to payment processors the App does not use), added subscription auto-renewal and cancellation terms, added provisions covering earned virtual currency, reward features, and referral anti-fraud, updated the feature description and third-party service list, corrected the tagline reference, and added streak protection (Shield and Recovery) limits.
